Terms & Conditions
These Terms and Conditions (“Agreement”) govern the use of the NDIS Plan Management services (“Services”) provided by I Thrive Plan Management (“Provider”) to the participant (“Participant”) or their nominated representative (“Representative”). By accessing or using the Services, the Participant or Representative agrees to be bound by this Agreement.
Service Description:
- The Provider offers NDIS Plan Management Services to assist the Participant in managing their National Disability Insurance Scheme (NDIS) funding.
- The Provider will provide financial intermediary services, including processing payment requests, reconciling invoices, and managing financial records on behalf of the Participant.
- The Provider does not provide any support or care services directly to the Participant and is solely responsible for managing the financial aspects of the NDIS plan.
Eligibility:
- The Participant must have an active NDIS plan and be eligible for Plan Management services as stated in their NDIS plan.
- The Participant must provide accurate and up-to-date information necessary for the provision of the Services.
- The Provider reserves the right to refuse or terminate Services if the Participant does not meet the eligibility criteria or provides false or misleading information.
Participant Responsibilities:
- The Participant or their Representative agrees to provide all relevant information and documentation required for the provision of the Services.
- The Participant is responsible for ensuring that all invoices and payment requests submitted to the Provider are accurate, valid, and related to NDIS-approved supports and services.
- The Participant must notify the Provider promptly of any changes to their NDIS plan, contact details, or other relevant information.
- The Participant acknowledges that they remain responsible for monitoring their NDIS funding, managing service agreements with providers, and ensuring compliance with NDIS rules and guidelines.
Payment and Fees:
- The Provider will charge a fee for the provision of Plan Management services, as agreed upon between the Participant and the Provider.
- The fee structure will be outlined in a separate Service Agreement or Fee Schedule provided to the Participant.
- The Participant authorises the Provider to deduct the agreed-upon fees from their NDIS funds or any other funding source as permitted under the NDIS guidelines.
- The Participant agrees to pay any additional costs, penalties, or fees incurred due to their non-compliance with NDIS rules or mismanagement of funds.
Privacy and Confidentiality:
- The Provider will handle the Participant’s personal and sensitive information in accordance with the Privacy Act 1988 and the Australian Privacy Principles.
- The Provider will only disclose the Participant’s information to authorised personnel directly involved in the provision of the Services.
- The Provider will take reasonable measures to protect the confidentiality and security of the Participant’s information but cannot guarantee absolute security.
- The Provider may be required to share certain information with relevant authorities or third parties as required by law or NDIS auditing processes.
Termination:
- Either party may terminate this Agreement by providing written notice to the other party.
- The Provider reserves the right to terminate the Services immediately if the Participant breaches any provision of this Agreement.
- Upon termination, the Provider will cease providing Plan Management services and return any remaining funds to the Participant or transfer them to an alternate plan management provider as instructed by the Participant.
Limitation of Liability:
- The Provider will exercise reasonable care and skill in providing the Services. However, the Provider will not be liable for any loss, damage, or expense incurred by the Participant arising from their use of the services.
- The Participant agrees to indemnify and hold the Provider harmless against any claims, costs, or liabilities arising from their misuse or mismanagement of NDIS funds or non-compliance with NDIS rules and regulations.
Amendment:
- The Provider may update or modify this Agreement from time to time. Any changes will be communicated to the Participant or Representative.
- Continued use of the Services after any modifications to this Agreement will constitute acceptance of the revised terms.
Governing Law and Jurisdiction:
- This Agreement shall be governed by and construed in accordance with the laws of Australia.
- Any disputes arising from or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Australia.
By accessing or using the Services, the Participant or Representative acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions.
